COMMON QUESTIONS ABOUT THIS SETTLEMENT

  1. WILL I RECEIVE MONEY FROM THIS SETTLEMENT?
    • If a notice was emailed or mailed to you, you are a class member and will receive a payment unless you exclude yourself from the settlement (see Question 6, below).
  2. DO I HAVE TO DO ANYTHING TO RECEIVE MONEY FROM THIS SETTLEMENT?
    • No, a payment will be sent to you so long as you are a class member. However, it is important to let the Settlement Administrator know if your mailing address is incorrect or if you move before payments are made. See Section 19 of the Home Page of this website for important contact information.
  3. WHAT WILL I RECEIVE FROM THIS SETTLEMENT?
    • If you or a co-tenant paid $25.00 or less (but at least $0.01) toward your first water/sewer bill, the sum of $25.00 will be paid to the tenant(s) named in the lease (if more than one tenant was named in the lease, this amount will be divided among them equally).
    • If more than $25.00 was paid toward your first water/sewer bill, this amount will be refunded to the tenants (if more than one tenant was named in the lease, this amount will be divided among them equally). It is possible that this amount may be higher depending on administration expenses and how many tenants do not receive or cash their payment checks.
  4. WHEN WILL I RECEIVE PAYMENT?
    • Payments will be mailed if the Court grants final approval to the settlement. A final approval hearing is scheduled for March 27, 2025. If final approval is granted, payments should be received 60-75 days after.
  5. WHAT AM I GIVING UP AS A RESULT OF THIS SETTLEMENT?
    • If the settlement is given final approval by the Court, you will give up the right to sue any of the Defendants for failing to mail your apartment water submeter reading to you on the commencement date of your tenancy. However, if you exclude yourself from the settlement (see Question 6, below), you will not give up this right.
  6. CAN I EXCLUDE MYSELF FROM THE SETTLEMENT?
    • Yes, but to do so you must follow the procedures set forth in Section 14 on the Home Page of this website.
  7. CAN I OBJECT TO THE SETTLEMENT?
    • Yes, but to do so you must follow the procedures set forth in Section 15 on the Home Page of this website.
